Please read these Terms of Service ("Terms") carefully before using the HALY platform, website, and related services (collectively, the "Services") operated by HALY Health, Inc. ("HALY," "we," "us," or "our"). By creating an account or using our Services, you agree to be bound by these Terms.
1. Eligibility
HALY is designed for parents and legal guardians seeking behavioral health care for their children and adolescents. To create an account you must be at least 18 years old and have legal authority to consent to healthcare services on behalf of the minor you are registering. By using the Services, you represent that you meet these requirements and that all information you provide — including information about the minor in your care — is accurate and complete.
Adolescents 16 years of age or older may use certain features of the platform independently in jurisdictions where they have the legal capacity to consent to mental health treatment.
2. Nature of the Services
HALY is a technology platform that connects families with independent licensed pediatric behavioral health providers. HALY is not a healthcare provider, does not practice medicine, and does not provide medical advice, diagnosis, or treatment. The providers accessible through HALY are independent contractors, not employees or agents of HALY.
HALY is not an emergency services provider. Crisis contacts appear at the foot of every page.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@halychild.com if you suspect unauthorized access. You are liable for all activity that occurs under your account.
4. Appointments and Cancellations
- Appointments booked through HALY are subject to provider availability.
- Cancellations must be made at least 24 hours in advance to avoid a late-cancel fee, which may vary by provider.
- No-shows may result in a fee charged to the payment method on file and may affect your ability to book future appointments.
5. Fees and Payment
You agree to pay all fees associated with services received through the platform. HALY will verify your insurance benefits prior to your appointment and provide an estimated cost-share. You are responsible for any amounts not covered by insurance, including deductibles, copayments, and coinsurance. All payments are processed securely through our payment processor.
6. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of these Terms
- Impersonate any person or entity
- Submit false or misleading information about your health history, insurance, or identity
- Interfere with the security or integrity of the Services
- Attempt to access data not intended for you
7. Intellectual Property
All content, features, and functionality on the HALY platform — including but not limited to text, graphics, logos, and software — are owned by HALY or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HALY DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HALY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR YOUR RELATIONSHIP WITH ANY PROVIDER, EVEN IF HALY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Dispute Resolution
Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration under the rules of JAMS, unless you opt out within 30 days of first accepting these Terms by emailing legal@halychild.com. You waive the right to participate in a class-action lawsuit.
11. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
12. Changes to These Terms
We may revise these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the platform at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance.
